**THE WOODLANDS, TX – December 1, 2023** – The John Cooper School, a prominent private educational institution in The Woodlands, is currently embroiled in a significant legal battle, seeking to dismiss a $15 million lawsuit alleging student assault, negligence, and an attempted cover-up. The lawsuit, filed in July 2023 by the parents of a former student referred to as “John Doe” in court documents, claims their son was assaulted, including a sexual assault, by another student in a school bathroom in November 2022.

The parents contend that the school was negligent in its duties, failed to properly supervise students, conducted an inadequate investigation into the incident, and attempted to conceal what transpired. Their attorney, Kevin Green, is seeking $15 million in damages for negligence, gross negligence, and various other claims, asserting that the school’s actions or inactions led to significant harm for their son.

In response, The John Cooper School, through its attorney Christopher Johns, filed a motion to dismiss the lawsuit on November 21, 2023. The school argues that it responded “promptly and appropriately” to the allegations and that the parents’ legal claims lack merit. Specifically, the school’s defense asserts it did not owe a legal duty to prevent such an incident, did not act with malice, and maintains there is no evidence to support the “cover-up” allegations. The school’s motion states that it followed its established policies, thoroughly investigated the claims made by the parents, and took appropriate action based on those findings.

The legal proceedings are unfolding in Montgomery County court. Judge Jennifer Robin is scheduled to rule on the school’s motion to dismiss, a decision that could dramatically alter the trajectory of the case. Should the motion be granted, the lawsuit could be thrown out or significantly narrowed; if denied, the case would likely proceed to the discovery phase, potentially leading to a full trial.

The John Cooper School, known for its K-12 college preparatory curriculum and community involvement in The Woodlands, faces scrutiny over its campus safety protocols and incident response procedures as this lawsuit progresses.
