**Montgomery County Justice of the Peace Wayne Mack Arrested on Criminal Mischief Charge**

**CONROE, Texas –** Montgomery County Justice of the Peace Wayne Mack Waggoner, commonly known as Wayne Mack, was arrested Sunday evening, April 28, and booked into the Montgomery County Jail. Waggoner, 60, faces a Class B misdemeanor charge for criminal mischief following an alleged incident earlier this month.

The charges stem from an alleged act of vandalism on April 15 at the Kroger Fuel Station located at 12020 FM 1488 in Magnolia. According to records from the Montgomery County Sheriff’s Office, Judge Waggoner is accused of damaging an air pump at the fuel station. Reports indicate the pump was rendered “disabled” or “damaged beyond use,” with estimated repair or replacement costs valued between $100 and $750.

Following his arrest and booking, Judge Waggoner posted a $750 bond and was released from custody on Monday, April 29. A Class B misdemeanor in Texas carries potential penalties of up to 180 days in county jail, a fine of up to $2,000, or both. An arraignment date has not yet been set for the judge.

Judge Waggoner serves as the Justice of the Peace for Precinct 1, Place 1, a position he has held since 2014. In this role, he presides over misdemeanor criminal cases, traffic violations, small claims disputes, truancy cases, and conducts inquests. Prior to his election as Justice of the Peace, Waggoner served as the Precinct 1 Constable.

Beyond his judicial duties, Judge Waggoner is also a practicing pastor. This dual role has previously drawn scrutiny. In 2021, Waggoner was the subject of an ethics complaint filed with the Texas State Commission on Judicial Conduct. The complaint primarily concerned his practice of livestreaming church services from his courtroom during the COVID-19 pandemic and conducting religious ceremonies while in judicial attire. The Commission, which investigates allegations of judicial misconduct, typically either dismisses complaints or issues a public sanction. The outcome of that specific complaint was not publicly detailed, though Judge Mack has continued in his judicial role.

The Montgomery County Sheriff’s Office confirmed the arrest and charge but declined further comment on the ongoing investigation. Attempts to reach Judge Waggoner for comment were unsuccessful as of publication time. Representatives for Kroger were also contacted but did not immediately respond to requests for comment regarding the alleged incident.

Judge Waggoner is presumed innocent until proven guilty in a court of law. The Montgomery County Attorney’s Office would likely handle the prosecution of this misdemeanor case. This incident marks a notable legal challenge for an elected official in Montgomery County.
