**Conroe Man with Prior Sex Crime Convictions Arrested Again on Child Indecency Charges**

**CONROE, Texas** – A Conroe man with a documented history of convictions for sexual offenses against children has been arrested and charged again, this time for indecency with a child by exposure. Kevin Wayne Smith, 55, was taken into custody by deputies with the Montgomery County Precinct 2 Constable’s Office on September 16, 2022, following an investigation into an incident that allegedly occurred nearly a month prior.

The latest felony charge stems from an alleged incident on August 19, 2022, at a residence on Pine Forest Drive in Conroe. Smith is accused of exposing himself to an 11-year-old girl.

The Montgomery County Precinct 2 Constable’s Office initiated an investigation shortly after the alleged incident was reported, gathering evidence that led to Smith’s arrest last Friday. Details of the ongoing investigation, including how the alleged incident came to light, have not been fully released by authorities.

This new charge is particularly alarming given Smith’s extensive criminal history involving minors. Public records indicate Smith was convicted in 1998 for aggravated sexual assault of a child in Harris County. He faced subsequent charges and was again convicted in 2012 for sexual assault of a child in Galveston County. Due to these prior convictions, Smith is a registered sex offender, a status that mandates regular reporting to law enforcement and restricts where he can live and work.

Indecency with a child by exposure is classified as a second-degree felony under Texas law, carrying a potential penalty of 2 to 20 years in state prison and a fine of up to $10,000, if convicted. The severity of the charge reflects the serious nature of the alleged offense and the vulnerability of the victim.

As of Tuesday, Smith is being held without bond at the Montgomery County Jail. The decision to deny bond typically indicates that the court views the defendant as a potential flight risk or a danger to the community, especially given the nature of the charges and his criminal background.

Smith’s case has been assigned to Judge Vince Santini’s 2nd 9th State District Court, which handles felony cases in Montgomery County.
