Driver's 3rd DWI: BAC Over Twice Legal Limit

CONROE, Texas — A birthday celebration took an abrupt turn into a legal crisis early Sunday morning when a local man was arrested on his 46th birthday for his third alleged Driving While Intoxicated (DWI) offense.

Christopher Edward Zaleski was taken into custody by the Montgomery County Precinct 1 Constable's Office shortly after midnight on November 5. According to the official arrest report, a patrol deputy observed a white Ford F-150 traveling on State Highway 105 West near the Conroe city limits. The deputy reported that the vehicle was operating erratically, swerving across multiple lanes of traffic and narrowly avoiding a collision with the highway median.

Upon initiating a traffic stop, the responding deputy noted several signs of impairment, including slurred speech and instability. The report indicates that Zaleski admitted to the deputy that he had been consuming alcohol prior to getting behind the wheel. After failing a series of Standardized Field Sobriety Tests administered at the scene, Zaleski was transported to the Montgomery County Jail for formal processing.

Breath analysis performed at the facility yielded results of 0.176 and 0.175 blood alcohol concentration (BAC). Under Texas law, the legal limit for drivers is 0.08. The readings recorded for Zaleski are more than double the legal threshold for intoxication.

Court records reveal that this is Zaleski's third encounter with law enforcement regarding impaired driving, with prior DWI convictions documented in 2004 and 2006. In Texas, a third DWI charge is classified as a third-degree felony, which carries potential penalties including two to ten years in prison and significant fines.

Following his arrest on Sunday, Zaleski was booked into the Montgomery County Jail. Magistrate Judge Wayne Mack set his bond at $5,000.

This incident marks another enforcement effort by Montgomery County law enforcement, who have recently increased patrols along major thoroughfares like SH 105 to combat rising rates of impaired driving in the rapidly growing region. The Montgomery County District Attorney's office has historically taken a firm stance on repeat offenders, often utilizing specialized DWI courts to address recidivism among drivers with multiple prior arrests.
