Golden Corral Franchisee Seeks Bankruptcy, Corp Objects

CONROE, Texas – The future of the Golden Corral location in Conroe remains uncertain as its parent franchisee battles both financial insolvency and a high-stakes legal feud with the national corporate brand.

SCM Group, LLC, the franchisee operating the Conroe restaurant at 1400 N. Loop 336 West, officially filed for Chapter 11 bankruptcy protection on March 25 in the U.S. Bankruptcy Court for the Southern District of Texas, Houston Division. The filing encompasses nine locations in total, including restaurants in Harker Heights, Killeen, Pasadena, Victoria, and Waco, Texas, as well as three sites in Monroe, Shreveport, and West Monroe, Louisiana.

In court documents, SCM Group attributed the insolvency to a "perfect storm" of economic pressures that began during the COVID-19 pandemic. The company cited a sharp decline in revenue, consistent difficulty in maintaining a stable workforce, and the rising cost of goods as major contributors to its current deficit.

The filings highlight a fundamental shift in consumer behavior that the company claims left the buffet model vulnerable. While fast-casual competitors like Chick-fil-A saw continued success through drive-thru service during the pandemic, the buffet-centric nature of Golden Corral proved difficult to adapt to social distancing and safety restrictions.

This bankruptcy filing acts as the latest chapter in a growing conflict between SCM Group and Golden Corral Corporation. In December 2023, the parent corporation initiated a lawsuit against the franchisee, alleging widespread breaches of their franchise agreement. The lawsuit points to a failure to meet operational brand standards and asserts that SCM Group has failed to pay approximately $1.9 million in owed royalties and fees.

SCM Group disputes the corporate characterization of the debt, arguing in court filings that the brand made unreasonable and unfair demands that hindered the franchisee’s ability to recover. As part of its reorganization strategy, SCM Group is seeking court approval to reject its current franchise agreement entirely, a move that would legally sever ties with the Golden Corral brand.

While the legal battles play out, the restaurants continue to operate under a request from SCM Group to maintain standard business functions, including paying staff and settling debts with local suppliers.

Golden Corral Corporation is opposing the restructuring, filing motions to have the court convert the case from a Chapter 11 reorganization to a Chapter 7 liquidation. In its opposition, the corporation alleges that SCM Group has been guilty of gross mismanagement and is attempting to use the bankruptcy process as a vehicle to escape its contractual and financial obligations.

A hearing to determine the future of these restaurants is scheduled for April 17 in Houston.

Local customers should monitor the restaurant status as the court case progresses, as the outcome of the April hearing could lead to sudden closures if the court sides with the corporate entity or mandates a liquidation of assets.
