Off-Duty Firefighter Charged in Fatal Crash Evidence Tampering

CONROE, Texas – An off-duty Magnolia Volunteer Fire Department firefighter is facing felony charges following a fatal collision in Conroe that left one person dead and another critically injured.

Patrick William Miller, 35, was arrested by the Conroe Police Department on Wednesday, December 6, 2023. He has been charged with tampering with physical evidence, a third-degree felony, in connection with a two-vehicle crash that occurred early Sunday morning, December 3.

The fatal wreck took place at approximately 12:30 a.m. on FM 1488 near Mostyn Drive. According to investigators, a Kia Forte and a Dodge Ram pickup truck collided in a violent crash that claimed the life of 37-year-old Michael Smith. Smith was pronounced dead at the scene. His passenger, 39-year-old Stephanie Smith, suffered critical injuries and was rushed to a local hospital for emergency treatment. The driver of the Dodge Ram sustained non-life-threatening injuries.

The investigation into the circumstances of the crash took a turn when detectives with the Conroe Police Department’s Accident Investigation Unit reviewed dashcam footage and other evidence recovered from the scene. Authorities allege that Miller, who was off-duty and driving a Chevrolet Tahoe at the time of the incident, arrived at the scene and entered the Dodge Ram before law enforcement officers could secure the area. Investigators claim Miller removed an open container of alcohol from the pickup truck in an attempt to conceal it.

Following the discovery of the alleged tampering, police took Miller into custody. He was booked into the Montgomery County Jail and his bond was set at $30,000. Under Texas state law, a third-degree felony charge of tampering with evidence carries a potential penalty of two to ten years in state prison and a maximum fine of $10,000.

The Magnolia Volunteer Fire Department has not publicly released a statement regarding Miller’s employment status following the arrest. In similar cases involving emergency personnel, departments typically place individuals on administrative leave pending the outcome of the legal proceedings.

The primary crash investigation remains active and ongoing. Conroe Police officials have stated that they are working to piece together the events that led to the initial collision to determine if further charges against other involved parties are warranted.
