Spring Teacher Arrested for Improper Student Relationship

A former teacher at Spring Early College High School has been arrested and charged following an investigation into an illicit relationship with a minor student.
Brian Matthew Smith, 45, was taken into custody on the morning of February 21 at his residence in the 4700 block of Russett Street in Spring. He faces a second-degree felony charge of improper relationship between an educator and a student.
The investigation into Smith’s conduct began on February 15, when the Montgomery County Precinct 3 Constable’s Office received a formal complaint from the guardian of a female student. According to court documents, the alleged incidents took place between August 2023 and December 2023. The charges brought by the Montgomery County District Attorney’s Office cite specific instances of sexual contact and sexual penetration.
Following the receipt of the complaint, the district attorney’s office secured an arrest warrant for Smith on February 20. Officers apprehended him the following morning at approximately 9:30 AM. After being processed and appearing before a magistrate, Smith’s bond was set at $75,000. Jail records confirm that he has since posted bond and been released from custody.
Spring Early College High School, where Smith was employed, operates through a partnership between the Spring Independent School District and Lone Star College, with classes held on the college’s North Harris campus. Officials confirmed that Smith resigned from his teaching position in December 2023, the same month the alleged misconduct concluded.
In the wake of the arrest, school district administrators have emphasized their commitment to student safety. While the district is limited in what it can disclose regarding specific personnel matters, they are cooperating fully with the ongoing criminal investigation.
The charge of improper relationship between an educator and a student is a serious offense under Texas Penal Code Section 21.12. If convicted of the second-degree felony, Smith faces a potential prison sentence ranging from two to 20 years and a fine of up to $10,000.
