Unlicensed funeral director sued for estate theft

CONROE, Texas — A Montgomery County man is facing a civil lawsuit alleging he exploited the death of a Kingwood resident to orchestrate a systematic looting of a $2 million estate, all while operating under the guise of a licensed funeral professional.

The lawsuit, filed November 28, 2023, in the Montgomery County 9th District Court by Kevin W. Stoecklein, accuses 64-year-old Charles T. "Chuck" Brown of preying on a grieving family. Stoecklein, acting as the executor for the estate of his father, David Lawrence Stoecklein, claims Brown fraudulently misrepresented himself as a licensed funeral director to gain access to the family home and assets shortly after his father died on July 27, 2023.

Legal counsel from The Strong Firm P.C., representing the estate, alleges that Brown’s scheme involved more than just burial services. According to the complaint, Brown allegedly gained entry to the Kingwood residence and removed a vast array of high-value personal property. The missing assets include a collection of classic vehicles—a 1968 Ford Mustang, a Chevrolet Corvette, and a 1966 Ford F100—along with a cache of firearms including an AR-15 rifle and a vintage Luger. The filing further alleges the theft of silver coins, extensive tool collections, and a stamp collection.

Perhaps most damaging, the suit contends that Brown intercepted and diverted funds from the deceased’s Charles Schwab brokerage account into his own private accounts. Furthermore, the executor alleges that Brown confiscated David Stoecklein’s original will, falsely informing the family that the document was invalid.

State records provide a stark contrast to the professional facade Brown allegedly presented to the family. Data from the Texas Funeral Service Commission confirms that Brown’s funeral director and embalmer licenses have been expired since 2006. Additionally, there is no state record of a registered funeral establishment operating under the name "American Family Cremations."

This is not the first time Brown has faced allegations of theft. A review of public criminal records reveals a history of financial misconduct in Montgomery County. In 2011, Brown was convicted of a felony theft charge, which resulted in three years of deferred adjudication. In 2018, he was convicted of misdemeanor theft, for which he served 120 days in jail.

When reached for comment regarding the allegations, Brown struck an erratic tone, claiming to be the target of an extortion and blackmail plot. While he maintained he had known the Stoecklein family for four decades, he declined to clarify his role in the funeral arrangements or the status of the missing will. Before abruptly ending the phone call, Brown stated, "I'm a celebrity, you should know that."

The civil complaint against Brown includes claims of fraudulent misrepresentation, breach of fiduciary duty, conversion, theft, and multiple violations of the Texas Deceptive Trade Practices Act.

The case remains active in the 9th District Court. Legal experts suggest that the civil discovery process, which allows attorneys to subpoena bank records and demand the production of documents, will be critical in determining whether the missing estate assets can be recovered.

Family members and local authorities are urging residents to verify the credentials of any funeral service provider through the Texas Funeral Service Commission website before engaging their services, particularly during times of vulnerability. For families who suspect they may have been victimized by unauthorized funeral operators, officials recommend contacting the Montgomery County District Attorney’s Office or filing a complaint with the state regulatory board.
